Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Test Series platform available at exam.managedesk.in (the "Platform"), operated by ManageDesk, headquartered in Gurgaon, Haryana, India. By registering for an account or using the Platform, you agree to be bound by these Terms in their entirety. If you do not agree with any part of these Terms, you must not use the Platform.

1. Eligibility and Account Registration

The Platform is intended for students preparing for the National Eligibility cum Entrance Test (NEET). You must be at least 16 years of age to create an account. By registering, you represent that all information you provide — including your name, email address, mobile number, and state of residence — is accurate, current, and complete. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at support@managedesk.in if you suspect unauthorized access to your account.

2. Platform Services

Test Series provides stage-based mock tests designed to simulate real examination patterns including NEET and SSC CGL. The Platform includes features such as timed tests with exam-specific question counts and marking schemes, automated scoring, All India Ranking based on score and time taken, detailed performance analytics, and result publication after each stage. We reserve the right to modify, suspend, or discontinue any feature of the Platform at any time without prior notice.

3. Test Rules and Anti-Cheating Policy

All tests must be completed honestly and independently. The following rules apply during every test session:

Tab Switching Policy: The Platform monitors browser tab and window focus during active test sessions. You will receive a warning each time you switch away from the test tab. After receiving 3 warnings, any subsequent tab switch (the 4th instance) will result in immediate and automatic cancellation of your test attempt. This cancellation is final and irreversible.

Prohibited Conduct: You shall not use any external aids, notes, textbooks, or electronic devices during a test; copy, reproduce, or distribute test questions in any form; share your account or test access with another person; use automated tools, bots, or scripts to interact with the Platform; or attempt to manipulate your score, time, or ranking by any means.

Violation of any test rule may result in cancellation of the attempt, suspension or permanent termination of your account, and forfeiture of any fees paid.

4. Payment Terms

Pricing Structure: Stage 1 offers the first attempt free of charge. All subsequent attempts for Stage 1 and all attempts for Stages 2 through 5 require payment. Retest fees increase progressively with each additional attempt as displayed on the Platform at the time of payment.

Payment Processing: All payments are processed securely through Cashfree Payments, a PCI-DSS compliant payment gateway. By making a payment, you agree to Cashfree's terms of service in addition to these Terms.

Cancelled Attempts Count as Used Attempts: If your test is cancelled due to violation of the anti-cheating policy (e.g., excessive tab switching), that attempt is counted as a used attempt for pricing purposes. You will be required to pay the applicable retest fee to take the test again.

5. No Refund Policy

All payments made on the Platform are final and non-refundable. This includes, without limitation: fees paid for test attempts that are subsequently cancelled due to policy violations; fees paid for test attempts where you do not complete the test or submit early; fees paid for stages where you achieve a low score or are dissatisfied with the questions; and any other payment made for services rendered through the Platform.

We do not provide refunds, credits, or exchanges under any circumstances. By making a payment, you acknowledge and accept this no-refund policy. If you experience a genuine technical failure on our end that prevents you from accessing a paid test entirely (not due to your internet connection or device issues), you may contact us at support@managedesk.in and we will evaluate the situation at our sole discretion.

6. Intellectual Property

All content on the Platform — including but not limited to test questions, answer explanations, platform design, source code, graphics, logos, and trademarks — is the exclusive property of ManageDesk or its licensors and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Platform for personal, non-commercial educational purposes only. You shall not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any Platform content without prior written consent from ManageDesk.

7. Rankings and Results

All India Rankings are calculated based on the score achieved and time taken to complete the test. Rankings are published at the discretion of the Platform administrators and may not be available immediately after test completion. We make reasonable efforts to ensure accuracy of scores and rankings; however, in the event of any discrepancy, the decision of the Platform administrators shall be final and binding. We reserve the right to modify rankings if we determine that any participant has violated these Terms.

8. Account Suspension and Termination

We reserve the right to suspend, restrict, or permanently terminate your account without prior notice and without liability if we determine, at our sole discretion, that you have violated these Terms, engaged in cheating or fraudulent activity, provided false registration information, misused the Platform or its features, or engaged in conduct that is harmful to other users or to the Platform's reputation. Upon termination, your right to access the Platform ceases immediately. Any fees paid prior to termination are non-refundable.

9. Limitation of Liability

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by applicable law, ManageDesk and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or interruption of service, arising out of or in connection with your use of the Platform, even if we have been advised of the possibility of such damages. Our total liability for any claim arising under these Terms shall not exceed the amount paid by you to the Platform in the 30 days preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless ManageDesk, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to your violation of these Terms, your use of the Platform, or your infringement of any intellectual property or other rights of any third party.

11. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Platform, you consent to the data practices described in the Privacy Policy.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms or the use of the Platform shall be subject to the exclusive jurisdiction of the courts in Gurgaon, Haryana, India. Before initiating any legal proceedings, you agree to attempt to resolve the dispute informally by contacting us at support@managedesk.in.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify registered users via email or a prominent notice on the Platform. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the modified Terms. If you do not agree with the modified Terms, you must stop using the Platform and may request deletion of your account.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.
